The benefits of the hadith of al-Qasamah.

The Shaykh : And in the hadith is evidence for considering seniority, due to the saying of the Prophet (peace and blessings be upon him): meaning he starts with the eldest. And in it is evidence that al-Qasamah is not restricted to the heirs, but rather it is for the 'asabah (residuary male heirs), contrary to the position of the companions (scholars) of the jurists who say that al-Qasamah is only for the heirs because they are the ones who inherit the blood money. And this hadith indicates the opposite, that it is for the 'asabah. The aspect of this is that the Messenger (peace and blessings be upon him) said: even though these are not brothers with them; they have a brother who is a cousin, and they are not brothers. But it can be said that the Messenger (peace and blessings be upon him) ordered that the eldest speak, then the next eldest, and the turn for the oaths did not come, so this issue needs clarification.
