Benefits of the Hadith: (Whoever has two wives...)
Machine translationRead the Arabic original
The Shaykh : In this hadith, there are the following benefits:
A warning against inclining toward one of the wives, based on his saying:.
And among its benefits: the obligation of justice between two wives or more. What is the evidence for this obligation?
The threat of punishment for leaving it, because one of the signs of obligation is the command, for example, and if one is threatened for leaving something, this indicates its obligation, because there is no threat except for the commission of a forbidden act.
And among the benefits of this hadith is the affirmation of the Resurrection, based on his saying:.
And among its benefits: that the reward is of the same kind as the deed, because when he inclined away from justice in this world, on the Day of Resurrection his face was twisted,.
So if someone asks: By what is justice achieved?
We say that the scholars (may Allah have mercy on them) differed on this:
Some of them said: Justice is obligatory in what is obligatory.
And some of them said: It is obligatory in what is obligatory, what is recommended, and what is permissible.
Those who said that it is obligatory in what is obligatory said: It is obligatory to be just between the wives in the obligatory maintenance, and there is no obligation of justice in what exceeds that. So if he gives each of them her sufficient amount of food, drink, clothing, and housing, he may give the other more than that. Based on this: If he gave each of them the obligatory maintenance due to him, and then gave one of them jewelry, coins, vessels, and bedding that he does not give to the other, is he, according to this opinion?
Just and not sinful, because he fulfilled the obligation, and what exceeds it is voluntary, and the voluntary is a favor, and no one prevents a favor.
The second opinion in the issue is that justice is obligatory in what is obligatory, what is recommended, and what is permissible, in everything, in whatever he is able to do. Accordingly: It is not permissible to give one of the two wives more than the other, even if he has fulfilled her obligatory maintenance, because everyone knows that this is an inclination. If he gave one of them what is required of maintenance, and put the other in a grand palace and brought her all kinds of gold and jewels.
