The Shaykh : Praise be to Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, and upon his family and his Companions and his followers with excellence until the Day of Judgment.
As for what follows:
So what we have previously spoken about does not require much research in it because it is clear, but we begin with a new lesson, which is His saying:
"And from Abu Hurayrah (may Allah be pleased with him), he said: The Messenger of Allah (peace and blessings be upon him) said:
Safeguard yourselves from the two matters which cause accursing that befalls the one who relieves himself on people’s path-ways and under the shades. اتقوا اللاعنين : الذي يتخلى في طريق الناس أو ظلهم

His saying:
Beware اتقوا
means: "Beware," because the meaning of taqwa (piety) is taking precaution against what is to be avoided, so the meaning of "Beware" is "Beware."
And His saying:
the two cursed ones اللاعنين
: is an active participle. Is it in the form from which it is derived, i.e., that it is an active participle, or is it an active participle in the sense of a passive participle?
Both are possible. So on the first view:
Beware of the two cursed ones اتقوا اللاعنين
: he is called "the cursed one" because he is a cause of being cursed. And on the second view, it is an active participle in the sense of a passive participle, because the active participle comes in the meaning of the passive participle, as in His saying, the Exalted:
So he will be in a pleasant life - فهو في عيشة راضية
[Al-Haqqah 69:21]
meaning: pleasing.
In any case, even if we say that it is in the meaning of a passive participle, i.e., the cursed ones, the one intended by "the cursed one" is the doer, and the meaning of "cursing" is expulsion and distance from the mercy of Allah.
And the Prophet (peace and blessings be upon him) was asked about the two cursed ones, so he said:
easing in the watering places and on the thoroughfares, and in the shade (of the tree)(where they take shelter and rest). الذي يتخلى في طريق الناس أو ظلهم
Sunan Abi Dawud 25Sahih (Al-Albani)
:
relieves himself يتخلى
, meaning: he relieves himself and empties what is in his belly of harm.
in the path of people في طريق الناس
meaning: what people travel on.
or in their shade أو ظلهم
: meaning: what they take shelter in. And that is because people in the days of summer need shade, so they take shelter from the sun in the shade of walls or trees or other things. And that is because the one who relieves himself in the path of people or in their shade undoubtedly harms them from several aspects:
First: from the aspect of smell, because the smell of the place of relief is foul and stinking, so people are harmed by it. Second: from the aspect of disgust and aversion, because when a person sees the place of relief, he is disgusted by this thing and complains about it and feels revulsion, and perhaps some people are unable to bear seeing what they dislike until they vomit.
The third aspect: that he harms them from the aspect of their becoming contaminated by it. So if they become contaminated by this place of relief, what happens, O Jabir?
The student: Germs.

The Shaykh : Do germs occur?
The student: The smell.

The Shaykh : The smell, we have finished with that. Mahmoud, yes?
The student: It contaminates them.

The Shaykh : Yes, contamination of their feet or their leather socks or their clothes also occurs.
Also: there is harm in that it deprives them of this gathering in which they sit and take refuge, where they converse and dispel boredom and tedium from themselves. For this reason, the Prophet (peace and blessings be upon him) made relieving oneself in this place one of the causes of being cursed, meaning: that a person is cursed because of that.
