The reader: In the name of Allah, the Most Gracious, the Most Merciful.
Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions:
He said -may Allah have mercy on him-: "Chapter on the Prohibition of Defecating in People's Paths, Their Shade, Water Sources, and the Like:
Allah the Exalted said:
And those who harm believing men and believing women for [something] other than what they have earned have certainly born upon themselves a slander and manifest sin. والذين يؤذون المؤمنين والمؤمنات بغير ما اكتسبوا فقد احتملوا بهتانا وإثما مبيناً
[Al-Ahzab 33:58]

It was narrated from Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said:
Be on your guard against two things which provoke cursing. They (the hearers) said : Prophet of Allaah ( sal Allaahu alayhi wa sallam), what are these things which provoke cursing: easing in the watering places and on the thoroughfares, and in the shade (of the tree)(where they take shelter and rest). اتقوا اللاعنين ، قالوا: وما اللاعنان ؟ قال : الذي يتخلى في طريق الناس أو ظلهم

It was narrated from Jabir (may Allah be pleased with him):
The Messenger of Allah (ﷺ) forbade urinating into stagnant water أن رسول الله صلى الله عليه وسلم نهى أن يبال في الماء الراكد

The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful:
The author said -may Allah have mercy on him- in his book *Riyad al-Salihin*: "Chapter on the Prohibition of Defecating in People's Paths, Their Shade, or the Like":
Defecating: means expelling feces from the anus, and urinating is like it. So it is not permissible for a person to urinate or defecate in the path of people,
or in their shade أو في ظلهم
: means the place where they take shade, and also their sunny spot in winter, and also their gathering places. For this is among the harms to the believers. And Allah the Exalted said:
And those who harm believing men and believing women for [something] other than what they have earned have certainly born upon themselves a slander and manifest sin. والذين يؤذون المؤمنين والمؤمنات بغير ما اكتسبوا فقد احتملوا بهتانا وإثما مبينا
[Al-Ahzab 33:58]

: by word or by deed. So harm by word is like shaming, reprimanding, cursing, and the like. And by deed is like urinating in his path or defecating in his path or the like.
And His saying:
for [something] other than what they have earned بغير ما اكتسبوا
[Al-Ahzab 33:58]
: means not if the cause of that is those who were harmed, meaning that they exposed themselves to what harms them, so this is their crime in their own hands.
Then he mentioned the hadith of Abu Hurayrah (may Allah be pleased with him): that the Prophet (peace and blessings be upon him) said:
Be on your guard against two things which provoke cursing. Sunan Abi Dawud 25Sahih (Al-Albani)
: "Al-La'in" is the active participle from "la'n" (cursing), and the Prophet (peace and blessings be upon him) named that person "al-La'in" (the cursed one) because he is a cause for cursing. So the one who relieves himself in the path of people or relieves himself in their shade is cursed, may Allah protect us from that.
And also, whoever sees urine or feces in the path of people or in their shade, he has the right to say: "O Allah, curse the one who did this," because he is the one who exposed himself to that.
