The Shaykh : Welcome to you.
The questioner : This is a message we received from Muhammad Shalabi Musa al-Shahri from Dammam. He says to me: My mother passed away, and she had money. I am her only child and her only heir. I intend to perform Hajj on her behalf. Is it permissible to perform Hajj from her specific money, or should I perform Hajj for her from my own money? Please advise us. May Allah reward you with the best reward if Allah grants us the ability to perform Hajj?
The Shaykh : Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and his Companions, and those who follow them in excellence until the Day of Judgment. This money that you inherited from your mother, and for which you are her only heir, is your money. Allah has bequeathed it to you, and you may do with it what you do with your own money. However, if your mother was obligated to perform the Hajj of Islam during her lifetime and she did not perform it, then it is obligatory for you to perform Hajj on her behalf. As for if she had already fulfilled the obligation, or if it was not obligatory upon her during her lifetime because the money you inherited from her was the price of her basic necessities which were sold after her death, then Hajj is not obligatory upon you in this case. But if you perform Hajj on her behalf, we hope that there is good in that. It makes no difference whether you perform Hajj for her from your own money or from this money you inherited from her, because the money you inherited from her became part of your ownership upon her death, so there is no difference between it and what you had previously.
