The questioner : His other question asks: If a man commits unlawful sexual intercourse with a woman, whether she is married or unmarried, and the woman gives birth to a daughter from this adulterer, is it permissible for the adulterer to marry this daughter or not? Please inform us. May Allah reward you with good?

The Shaykh : Before answering his question, Muslims should know that unlawful sexual intercourse is one of the major sins and a grave sin among the gravest. Allah (Blessed and Exalted is He) has established for it in this world a deterrent punishment that also serves as expiation. This punishment is that if the adulterer is unmarried, meaning he has not married, it is obligatory for him to be flogged one hundred lashes and exiled from the town for one year. If he has married and has fully enjoyed his wife, then if he commits unlawful sexual intercourse after that, it obligates upon him stoning with stones until he dies. This is evidence of the ugliness of this act. Allah the Exalted described it as a grave sin and an evil path, saying:
And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way. ولا تقربوا الزنا إنه كان فاحشة وساء سبيلا
[Al-Isra 17:32]
However, if a person is afflicted with this matter and his soul urges him to it and he is struck by it, it is obligatory for him to repent, cease, seek forgiveness from Allah (Mighty and Majestic), and resolve not to return to it. Then, if a child is conceived from his semen, this semen is corrupt because it is from unlawful intercourse, and the child is not legally attributed to him. Nevertheless, it is not permissible for him to marry if the child is a daughter conceived from his semen. This is because if breastfeeding, which is the nourishment of the child with milk resulting from a man's pregnancy, has an effect in prohibiting the breastfed child such that she becomes forbidden to the owner of the milk, the clarification of this is that if a girl is breastfed by a man's wife, then if this girl is breastfed the amount that is legally significant, she becomes his daughter through breastfeeding, and it is not permissible for him to marry her.

The questioner : Yes.

The Shaykh : Because she was nourished from milk that resulted from this husband's pregnancy, how much more so if she was created from his semen? Then she is even more deserving of prohibition. Therefore, we say that this daughter who was created from the adulterer's semen is not considered his daughter legally, but it is not permissible for him to marry her or to marry any of her descendants, because she was created from his semen. Yes.
