The issue of the grandfather’s inheritance alongside the brothers.
Machine translationRead the Arabic original
Branching from this is the issue of fixed shares, which is that the grandfather excludes the brothers, whether they are full brothers, paternal half-brothers, or maternal half-brothers. The exclusion of maternal half-brothers by the grandfather is by consensus. As for full brothers or paternal half-brothers, there is scholarly disagreement regarding their inheritance alongside him. The correct view, without doubt, is that they do not inherit alongside the grandfather. If a person dies leaving behind his father, his father’s father, his father’s father’s father, the grandfather of the seventh degree, and a full brother, then the full brother gets nothing. This is because the grandfather is a father, and a father excludes brothers. It is also because this son, who is a descendant of the seventh-degree grandfather, is a part of him, unlike the brother, who is not a part of him. It is well known that the root from which this branch descends is more entitled to inheritance than a person who is neither a root nor a branch of him. This is an issue that will be verified, if Allah wills, in the law of inheritance shares.
