Inheritance of the Children of Brothers

Q: I hope you will inform me about two full brothers, from the same mother and father, one of whom died leaving two sons and two daughters. After a period of more than five years, the uncle of the sons and daughters, who was their father’s brother, died without leaving any heir other than his brother’s sons. Will what the uncle, their father’s brother, left behind go to the sons
and daughters, or will it go to the sons only, with the daughters being excluded?
Please guide us to the correct ruling, and may Allah guide you.

A: If the matter is as described, then after settling the debts of their deceased uncle and executing his lawful bequest, the remainder belongs to his brother’s male children, to the exclusion of the females. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
