The Shaykh : Pay attention to his statement: "the proximity to 'Arafah". It becomes clear to you that the Shaykh al-Islam (may Allah have mercy on him), as well as the majority of the scholars except for a few, hold the view that Namirah is not part of 'Arafah, and this is the truth without doubt.
However, the hadith of Jabir (may Allah be pleased with him) poses a difficulty here, in which he said:
When he mentioned the Prophet's (peace and blessings be upon him) journey to 'Arafah, he said: "And the Quraysh had no doubt that he would stand at al-Mash'ar al-Haram, meaning Muzdalifah, as the Quraysh used to do in the pre-Islamic age of ignorance. So he passed through until he reached 'Arafah." لما ذكر سير النبي صلى الله عليه وسلم إلى عرفة قال: ولا تشك قريش إلا إنه واقف عند المشعر الحرام يعني مزدلفة كما كانت قريش تفعل بالجاهلية فأجاز حتى أتى عرفة
. It is well known that a tent was pitched for him at Namirah and he remained there until the sun passed its zenith. Some scholars misunderstood his statement
until he reached 'Arafah حتى أتى عرفة
to mean that Namirah is part of 'Arafah. But the clear intent of Jabir (may Allah be pleased with him) is that he passed through until he reached 'Arafah and stood there, and he did not stand at what? At Muzdalifah. This is because the Quraysh, out of their stubbornness and arrogance, said, "We cannot stand on the Day of 'Arafah at 'Arafah. 'Arafah is in the open land (al-Hil), and we are the people of the Sacred Precinct (al-Haram); we do not stand except at Muzdalifah." Do you understand?

The Shaykh : Therefore, Allah said to us:
depart from the place from where [all] the people depart أفيضوا من حيث أفاض الناس
[Al-Baqarah 2:199]
, meaning from 'Arafah.
The important point is that the Shaykh al-Islam's (may Allah have mercy on him) statement here is explicit that Namirah is not part of 'Arafah. For this reason, if someone were to stand there until the sun set and then leave, his Hajj would not be valid. I do not know about those who said it is part of 'Arafah: do they commit to the validity of their Hajj in this situation or not? Yes.
