The questioner : There is a man who has an orchard, and the fruit of one of the palm trees has ripened, and he sold it to Zayd!

The questioner : And he sold the rest to 'Amr.

The Shaykh : The one that had not ripened?

The questioner : Yes.

The Shaykh : No, it is not permissible. Even if he sold the ripened fruit to Zayd, and then came with another transaction and sold him the fruit that had not ripened, it would not be permissible.

The questioner : Shaykh, is it when a single grain appears on a palm tree, or must the Bedouins wait for all the fruit of the palm trees?

The Shaykh : Are you sleeping or awake?

The questioner : If it appears and he eats it.

The Shaykh : You did not realize anything except for eating, yes.

He said -may Allah have mercy on him-: "And from Jabir ibn 'Abdullah (may Allah be pleased with them both) who said: The Messenger of Allah (peace and blessings be upon him) said:
If you were to sell fruits to your brother) and these is a stricken with Calamity, it is not permissible for you to get anything from him. Why do you get the wealth of your brother, without jutification? لو بعت من أخيك ثمرًا فأصابته جائحة فلا يحل لك أن تأخذ منه شيئا بم تأخذ مال أخيك بغي حق
