Continuation of the explanation of the issues of the previous chapter. The Tenth: There is no vow in disobedience.

The Shaykh : Or the dress happened to be similar, whether you intended it or not, you are prohibited from this matter. Did you understand this issue? And this is an issue on which the Shaykh al-Islam, Ibn Taymiyyah, also stated that the occurrence of imitation does not require intention; it is prohibited even if one did not intend it. If a man wears a woman's clothing and says, "I did not intend to imitate women," we say that even if you did not intend it, as long as the similarity occurred, you are prohibited, even if you did not intend it. However, with intention, the sin is greater. For this reason, the Shaykh al-Islam, Muhammad ibn 'Abd al-Wahhab (may Allah have mercy on him), says: "Even if he did not intend it".
"The Tenth: There is no vow in disobedience". The hadith says:
There is no fulfillment of a vow لا وفاء لنذر
There is a difference between them. If the phrase is "There is no vow in disobedience," the meaning is that the vow is not established. If it is "There is no fulfillment," the meaning is that the vow was established, but it is not fulfilled. Yes, the Sunnah has come with both this and that. It has come with the wording
There is no vowing in disobedience to Allah لا نذر في معصية الله
Jami` at-Tirmidhi 1525Sahih (Darussalam)
but "no vow" is understood to mean "no fulfillment of a vow," based on the saying of the Prophet (peace and blessings be upon him) in the authentic hadith agreed upon by al-Bukhari and Muslim:
and whoever vows to disobey Allah, let him not disobey Him. ومن نذر أن يعصي الله فلا يعصه
Sunan Ibn Majah 2126Sahih (Darussalam)

"The Eleventh: There is no vow for a human being in that which he does not own". This is like "There is no vow in disobedience," meaning there is no fulfillment of a vow in that which a human being does not own. And we have mentioned to you that what one does not own includes what one does not own by Shari'ah and what one does not own by divine decree. Yes.
The student: Is it required that the act be worship, or even in ordinary matters?

The Shaykh : ... ordinary matters. And for this reason, they said that imitating the disbelievers in clothing and other things is forbidden.
The student: ... .

The Shaykh : Like what?
The student: ... like eating with spoons; this was not intended as imitation.

The Shaykh : But is this a characteristic of the disbelievers?
The student: ...

The Shaykh : No, it is well known, well known from long ago. Yes, even among the jurists, it was used, even by Muslims. And also ... which is ... well known from the time of Anas (may Allah be pleased with him). But for example, if we eat with something that is a characteristic of theirs, if a person sees it, he says, "This is the food of the disbelievers" or "These are the vessels of the disbelievers" ... but if this thing becomes widespread in strength and spreads, and there is no difference between Muslims and others, it is permissible. For example, what they call the "pantalon" was not known at first, but now it has spread and become common to Muslims and disbelievers.
The student: ... the trousers

The Shaykh : Yes, but trousers with a shirt over them, or a cloak over them ... yes, and trousers.
The student: ...

The Shaykh : ... but with a shirt or a cloak over them.
You mentioned the saying of Allah the Exalted ... Yes, good. The saying of Allah the Exalted:
Do not stand [for prayer] within it - ever لا تقُم فيه أبداً
[At-Tawbah 9:108]
Did we discuss it or not? We are done with that chapter. Good.
