Explanation of those who are exempted from the trial of the grave.

Machine translationRead the Arabic original
The Shaykh : As for the trial, it is that a person is asked about his Lord, his religion, and his Prophet after he is buried, right? We have previously mentioned that the author’s statement: "People are tried" appears to be general, but the prophets are exempted from it, because they are asked about them. We may also say that the question of the prophets is not included in the author’s statement, because he says, "It is said to the man: Who is your Lord? Who is your Prophet?" Yes.
Second: The martyrs are exempted, based on the hadith that came regarding this, that they are safe from the questioner in the grave, and that the Prophet (peace and blessings be upon him) attributed this to His saying:
The flashing of the swords above his head is trial enough. كفى ببارقة السيوف على رأسه فتنة
Sunan an-Nasa'i 2053Sahih (Darussalam)
.
Third: The sincere friends of Allah (al-Siddiqun) are exempted, because they are better than the martyrs and more truthful. For this reason, the word "Siddiq" is on the pattern of Fa'il. If the martyr is not asked because of the truthfulness of his faith and his exposing his neck to being killed, then the Siddiq is even more truthful than he is.
This is the view adopted by Ibn 'Abd al-Barr (may Allah have mercy on him), but Ibn al-Qayyim preferred that the Siddiq is asked, and he said: "The original rule is generality until valid evidence comes for an exception".
Fourth: Children and the insane, for they are not asked, because they are not accountable. It is possible to take from the author’s statement: "It is said to the man" that a small child is not among the men, but among the children.
We mentioned that there are two opinions among the scholars regarding this issue. Some said that they are asked and inspired with the answer, even though they are not accountable. Others said that they are not asked. Both opinions are in the madhhab of Imam Ahmad (may Allah have mercy on him).
Fifth: Among those who are exempted.
The student: The insane.

The Shaykh : They are included among the young ones.
The disbelievers, the pure disbelievers, because there is no need to ask them, as their state is known. This is also the view adopted by Ibn 'Abd al-Barr, but Ibn al-Qayyim leans toward the view that the disbeliever is asked. He is asked by way of rebuke, by way of rebuke, and not by way of seeking information, for example, or testing. Rather, he is asked as one who is being rebuked, just as he is asked when he enters the Fire:
Did there not come to you a warner?" (9) They will say," Yes, a warner had come to us ألم يأتكم نذير قالوا بلى قد جاءنا نذير
[Al-Mulk 67:8-9]
and so on.
The student: And what is the stronger opinion?

The Shaykh : Yes? By Allah, I hesitate on this, because His saying:
I heard the people saying something and I said it too سمعت الناس يقولون قولا فقلته
Sunan Ibn Majah 4268Sahih (Darussalam)
does not apply to the disbeliever; it only applies to the hypocrite. As for the disbeliever, it does not apply to him.
The student: In a narration.

The Shaykh : Yes? It includes the disbeliever, and there is a narration: "the disbeliever or the open sinner," or "the disbeliever or the hypocrite." Some of them are with doubt, some with conjunction, and some are restricted to the open sinner.
The student: ... .

The Shaykh : Which one?
The student: ...

The Shaykh : No, that is on the Day of Resurrection. Also, he is not asked by way of seeking information; rather, it is a question of rebuke.
In any case, we may say that the apparent meaning of the Qur'an
Allah keeps firm those who believe, with the firm word, in worldly life and in the Hereafter يثبت الله الذي آمنوا بالقول الثابت في الحياة الدنيا والآخرة
[Ibrahim 14:27]
may be said to indicate that the disbeliever is asked, because of His saying:
And Allah sends astray the wrongdoers ويضلّ الله الظالمين
[Ibrahim 14:27]
, but it is not certain, because it is possible to say that the intended meaning of "the wrongdoers" is whom? The hypocrites. And Allah says:
Allah keeps firm those who believe, with the firm word يثبت الله الذي آمنوا بالقول الثابت
[Ibrahim 14:27]
.
In any case, their matter is held in abeyance.
Are those other than this Ummah asked? We mentioned that they are asked.
As for the answer of the one being asked, "My Prophet is Muhammad," it is because after the sending of the Messenger (peace and blessings be upon him), there is nothing but to say, "My Prophet is Muhammad." All the previous prophets say, "My Prophet," and they mention the name of their Prophet.
All right, he says:
