Question: A group was in Mina during the time of Hajj, and after stoning the pillars on the twelfth day, they intended to leave Mina, but they were unable to leave until some time after sunset due to the congestion. Is it obligatory for them to stay overnight in order to perform the stoning the next day?

Answer: If sunset overtook them after they had departed, then they owe no overnight stay, and they are in the status of those who have departed before sunset. However, if sunset overtook them before they had departed, it is obligatory for them to stay overnight that night, meaning the night of the thirteenth, and to stone the pillars after the sun passes its zenith on the thirteenth day. After that, they may depart whenever they wish, because the obligatory stoning ends on the thirteenth day. There is no blame on them for staying overnight in Mina or Makkah, and no stoning is required of them after the stoning of the thirteenth day, whether they stay in Makkah or in Mina.
