Q: I inform Your Eminence that I performed Hajj this year, and on the 12th day we were in al-Aziziyah in Makkah al-Mukarramah . We prayed the Dhuhr and Asr prayers shortened, and our intention was to hasten on the second day. So we went to stone the pillars in Mina, but we did not arrive until just before Maghrib. We stoned the small pillar, and the Maghrib adhan was called while we were in Mina . Then we completed stoning the middle and large pillars after the Maghrib adhan, and we left Mina for Ta'if . I should mention that on the Day of Sacrifice, after stoning the Jamarat al-Aqabah , we performed one tawaf (seven circuits) with the intention of both the Tawaf al-Ifadah and the Farewell Tawaf, and we did not perform any tawaf after that. What is the ruling on our actions? I should also mention that I had intercourse with my wife after I ascended to Ta'if.
A: Since the Maghrib adhan was called on the 12th of Dhul-Hijjah and you were in Mina without having completed the stoning of the pillars, it is obligatory for you to stay overnight on the night of the 13th and to stone the pillars on the 13th day. And since you left for Ta'if before performing these two acts of worship and before the Farewell Tawaf, which is the last thing a pilgrim does when he wants to leave Makkah , it is obligatory for you to pay a fidyah of a sacrificial animal for leaving the stoning, and a sacrificial animal for leaving the Farewell Tawaf. A single sheep, or a seventh of a camel, or a cow, slaughtered in Makkah and distributed to the poor of the Haram , is sufficient for the sacrificial animal. And for the fidyah of leaving the overnight stay on the night of the 13th, it is charity in the form of feeding a poor person. And whoever is unable to pay the fidyah of a sacrificial animal must fast for ten days for each sacrificial animal, either consecutively or non-consecutively. And what the questioner mentioned about their performing seven circuits on the Day of Sacrifice with the intention of the Tawaf al-Ifadah and the Farewell Tawaf is not valid regarding the intention of the Farewell Tawaf
because it is only performed after the completion of the Hajj rites when one wants to leave Makkah.
