Question: What is your opinion regarding a man who came upon a well that had been endowed in the path of Allah, so he installed a (mator) on it to draw the water, and he undertook to deliver the water to whoever wanted it at their location, but he does not give anyone any water until he takes some fee from them according to the amount of water they request?

Answer: If the authorities have approved him for this, or if it is in a country where its people have agreed to it, or if it was neglected, and Allah brought him to it and he repaired it, and installed the (mator) on it and provided the water to those in need of it, then there is no harm in that, and he is considered a reformer and a doer of good, even if he takes a fee for that according to his work.
As for if he is unjust in this; by the fact that there is someone who wants to deliver the water without a price, and he prevents him from doing so, and imposes his authority; so that he takes from the people's wealth what he wants, then this is not permissible, and the authorities and the people of the country must prevent him, and success is from Allah.
