Question:
What is your opinion regarding a man who came upon a well that had been endowed in the path of Allah, so he installed a pump to draw the water, and he undertook to deliver the water to whoever wanted it at their location, but he does not give anyone water until he takes some fee from them according to the amount of water they desire?

Answer:
If the authorities have approved him for this, or if there are no authorities in the town and the people of the town and village have agreed to this; because it was idle, so Allah sent him to fix it, they entrusted him with the pump, and it benefited them; there is nothing wrong with that.
As for if he is unjust in that: by finding that someone wants to deliver the water without a price and without effort, and he prevents them from that, and imposes his own order so that he takes from the people's money; this is prohibited.
As for if it is by mutual agreement between him and the people of the town, or out of his kindness; because it was idle, so he did good in that, and took a small amount and a small fee according to his effort, or if the authorities appointed him for this and agreed to it; there is nothing wrong with that.
