After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the questioner: the General Manager of the Ministry of Islamic Affairs branch in Jazan, Dr. Husayn ibn Ali al-Harbi
and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (6283) and date 19/5/1424 AH. The questioner asked a question, the text of which is: We convey to you the greetings of the honorable and distinguished Chairman and members of the Regional Endowments Council for the Jazan region, who wished to present one of the topics to you to seek your opinion and issue a fatwa on it. The topic is that one of the endowers—may Allah reward him with good—endowed a piece of land and built on it a mosque, an ordinary well, and an artesian well, according to the attached copy of the legal deed. His condition in it was (for the benefit of the mosque and the wells for watering the Muslims). Now the imam of the mosque has come forward requesting the provision of an electric submersible pump to lift water from the well from the income of the endowed land. Is it in accordance with the endower's condition to provide tools for lifting water from the wells using modern machinery (the electric submersible pump) and what is attached to it, such as an electric meter, circuit breakers, cables, and the like, from the yield of the endowment, or not? Please issue a ruling, may Allah reward you, and may Allah guide you. By contacting Dr. Husayn al-Harbi , he informed that there is income obtained from renting shops in this endowment, and the land is now within the residential area, with no agriculture on it.
After studying the inquiry, the Committee responded that there is no objection to providing a submersible pump to lift water from the endowed well and what is attached to it, such as an electric meter
and circuit breakers, cables, and the like; because it was stated at the end of the endowment deed number (253 2) and date 11/8/1417 AH, issued by the Shari'ah Court in Subay'ah in the words of the judge: (It has been established for me religiously that the land located in the village of Jakhayrah , whose extent and boundaries are specified above, and on which the mosque is situated, is Ali Munwar Habash's, his property during his lifetime, then he endowed it for the benefit of the mosque and the two wells for watering the Muslims). And among the necessities of watering from the two wells is providing what was mentioned above.
