Question: My husband is addicted to smoking, and he suffers from asthma. We have had several problems over his trying to quit. Five months ago, my husband prayed two units of prayer for Allah and swore he would not return to smoking, but he started smoking again a week after his oath. The problems between us returned, and I asked him for a divorce. However, he promised me that he would not return to it and would leave it forever, but I am not fully confident in him. Answer: Smoking is among the forbidden abominations, and its harms are many. Allah the Exalted said in His noble Book in Surat al-Ma'idah: [al-Ma'idah:4]. And He said in Surat al-A'raf, describing the Prophet Muhammad (peace and blessings be upon him): [al-A'raf:157]. There is no doubt that smoking is among the abominations. Therefore, it is obligatory for your husband to leave it and guard against it, in obedience to Allah the Exalted and His Messenger (peace and blessings be upon him), and out of fear of the causes of Allah's anger, and to preserve the safety of his religion, his health, and the goodness of your companionship with him.
It is obligatory for him to pay the expiation for an oath regarding his oath, along with repenting to Allah the Exalted for returning to it. The expiation is feeding ten poor people, or clothing them, or freeing a believing slave. It is sufficient in this to provide them with dinner, or lunch, or to give each person half a sa' (a dry measure of about 3 kg) of the local staple food, which is approximately one and a half kilograms. If he is unable to do so, he must fast for three days.
We advise you not to demand a divorce if he prays, has a good character, and has left smoking. However, if he persists in the sin, there is no harm in requesting a divorce. We ask Allah for him to be guided and to be successful in sincere repentance.
