Question: A woman married two men, and both of them passed away. She has one son and four daughters from the first husband, and two sons and one daughter from the second husband. One of her sons from the second husband passed away, leaving behind an estate. Do her children from her first husband inherit from their deceased maternal brother, given that the mother is still alive? What is the share of the son from the first husband and his four sisters, and what is the share of the full siblings of their deceased brother? The value of the estate is two hundred and fifty thousand riyals, and no more.

Answer: And upon you be peace, and Allah’s mercy and blessings, after that:
If the situation is as described in the question, then the estate of the deceased son is divided into six equal shares: one share for the mother, which is one-sixth; two shares for his maternal siblings, male and female, divided equally among them on the basis of five equal shares; and the remaining three shares for his full brother and full sister, with the male receiving the share of two females. This means that the male has two shares and the female has one share. May Allah guide them all. And peace be upon you, and Allah’s mercy and blessings.
