The questioner : A questioner says, O honorableThe Shaykh : A man had a child, or rather a person had only one child, and he died (may Allah have mercy on him) and left behind wealth.

The Shaykh : Did the father die or the child?

The questioner : The father. And he left behind wealth. This child lived until he reached the age of thirteen. Then he passed away and left behind the wealth he had inherited from his father. He has no one but his mother, his paternal grandfather, and his maternal brothers. So, O honorable Shaykh, do his maternal brothers inherit or not? And what is the share of his grandfather and the share of his mother?

The Shaykh : Maternal brothers do not inherit if one of the fathers or grandfathers is present through the male line. In other words: the father blocks the maternal brothers, the father’s father blocks them, the father’s father’s father blocks them, as long as the entire chain is male, the maternal brothers do not inherit. Also, the maternal brothers are blocked by daughters, sons, sons’ sons, and sons’ daughters; they block the maternal brothers. Now, the inheritance remains for his mother and whom? His grandfather. The mother gets one-sixth, by the saying of Allah (Blessed and Exalted is He):
And if he had brothers [or sisters], for his mother is a sixth فَإِنْ كَانَ لَهُ إِخْوَةٌ فَلأُمِّهِ السُّدُسُ
[An-Nisa 4:11]
. The rest is for the grandfather. And the maternal brothers have nothing. Yes.
