The sons of a son block the brothers
Machine translationRead the Arabic original
Question: A person came to me who identified himself as J. M. N. J, and stated that his grandmother, L. N. S., had passed away leaving behind three daughters, the children of her son who numbered seven—three males and four females—a full sister, a maternal brother, and her husband, as he put it. He asked me to divide the estate.
And the answer: If the facts are as the questioner stated, then the estate of the aforementioned grandmother is to be divided into twelve equal shares: the husband receives one-quarter, which is three shares; his daughters receive eight shares, which is two-thirds; and the remaining one share is to be divided among the aforementioned children of her son, with the male receiving the share of two females.
As for her sister and brother, they have no share, because the sons of her son block the brothers by the consensus of the scholars. So says the one who is in need of the forgiveness of his Lord, Abdul Aziz ibn Abdullah ibn Baz (may Allah forgive him), and may Allah send prayers and peace upon His Prophet Muhammad, his family, and his Companions.
