Question: From Abdulaziz ibn Abdullah ibn Baz to the honorable brother, the esteemed President of the Jawf Court, may Allah grant him understanding in all good, amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O lover, your noble letter number (123), dated 16/1/1392 AH, has been received, may Allah guide you. I understood what you recorded regarding the nature of the divorce pronounced by husband 'A. against his wife. It is that he and his wife, along with her guardian (who is her brother), appeared before your eminence and he admitted that on 25/11/1391 AH, a dispute occurred between him and the aforementioned wife, and as a result, he said to her: "By Allah, for a long time, you will not be my wife." He stated that he intended by this a divorce, even if it were to happen later, and not at that present moment. She requested a divorce, so he divorced her by saying to her: "Go away and turn your face away from me." You asked him about his intention in saying "Go away and turn your face away from me": did he intend divorce? He said: "Yes, I intended one divorce." He had not divorced her before this, nor after it. He took her back on 29/11/1391 AH. The guardian admitted before your eminence that he has no objection to the husband's statement, and there is no impediment for him in his wife returning to him. The wife also admitted that after the dispute that occurred between her and her husband, he said to her: "Go away," and she did not go away, so he kept repeating it until he said it three times and left. She then went to her parents' house, and she has no objection to returning to him.
Answer: Based on this, I issued a ruling to the aforementioned husband that one divorce has taken effect on the aforementioned wife through his aforementioned divorce, and his taking her back is valid, and she has two divorces remaining. I ask you to inform everyone of this, may Allah reward you and guide your steps, and may peace and the mercy of Allah be upon you.
