Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz to the honorable brother, may Allah guide him to all good, amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O lover, your noble letter has reached us, and may Allah guide you. The question it contained regarding the evidence upon which we base our ruling that three divorces are considered one if pronounced in a state of anger, up to the last point you mentioned in your letter, is known.
The answer is: It is authentically reported from the Prophet (peace and blessings be upon him) in the hadith of Ibn 'Abbas (may Allah be pleased with them both) that the three divorces were considered one during the time of the Messenger of Allah (peace and blessings be upon him), the time of Abu Bakr, and two years of the caliphate of 'Umar (may Allah be pleased with them both). However, when 'Umar (may Allah have mercy on him) saw that people were being lax with divorce, he saw that he should set a limit for that, so he considered the pronouncement of three divorces in a single utterance to be a final divorce (baynunah kubra). We issue the ruling that the pronouncement of three divorces in a single utterance is one divorce, based on this authentic hadith, even if it was not in a state of anger. It is not permissible for us to leave the saying of the Messenger (peace and blessings be upon him) for the saying of anyone else.
As for the divorce of the angry person, this has two cases: The first case is if he understands what he is pronouncing of divorce, then his divorce takes effect. As for if he is in a state of intense anger that deprives him of his sense until he does not know what he is saying of divorce, then his divorce does not take effect.
