A Question Concerning the Triple Divorce
Machine translationRead the Arabic original
Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz to the honorable brother, the esteemed head of the Bisha court, may Allah guide him to all good, amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O beloved, your noble letter number (2115), dated 29/10/1390 AH, has been received. May Allah guide you. I have reviewed the attached record, which contains your documentation of the divorce pronounced by the husband upon his wife. It states that he acknowledged to you that in the year 1389 AH, a dispute arose between him and the aforementioned wife, and he divorced her with three pronouncements using a single phrase. He then took her back based on a fatwa from your eminence. Then, in the month of Safar of this year, 1390 AH, a dispute arose between them, and he divorced her with three pronouncements using a single phrase, adding nothing to that and having nothing follow it. He then took her back in the third month from the date of the last divorce, and he witnessed to this with two witnesses. He brought them to your eminence, and they testified to his taking her back from the divorce of his wife, and that his taking her back occurred after two and a half months had passed from the date of the divorce that took place in the month of Safar, 1390 AH. The woman's father also came to you and confirmed what his son-in-law said, and he presented to your eminence a paper containing the last divorce, dated 2/2/1390 AH. Its content is that the aforementioned husband divorced the aforementioned wife with three pronouncements, making her forbidden to him and permissible to whoever seeks her.
Answer: Based on this, I issued a fatwa to the aforementioned husband that one pronouncement of divorce has taken effect on the aforementioned wife with his last divorce, which is added to the previous pronouncement, leaving him with one pronouncement. His taking her back is valid if it occurred before she exited the waiting period. It is authentically reported from the Prophet (peace and blessings be upon him) what indicates this, as is not hidden. I hope you will complete the necessary procedures and notify everyone of the aforementioned fatwa, and order the husband to repent from his divorce, as it is a reprehensible divorce, as your eminence knows. May Allah reward you, thank you for your efforts, and reward you with good for everyone.
And peace be upon you and the mercy of Allah and His blessings.
