Question: His Eminence Shaykh Abdul Aziz ibn Abdullah ibn Baz (may Allah preserve him)
Peace be upon you, and Allah's mercy and blessings.
What is your opinion regarding a man who divorces his wife three or seven times in a single sitting? Does the divorce take effect as three irrevocable divorces, or as one revocable divorce? Please clarify, and may you be rewarded. The woman was pregnant at the time of his divorce and remains so to this day.
Answer: And upon you be peace and the mercy of Allah and His blessings. As for what follows:
This is a matter of scholarly disagreement among the scholars, both past and present, regarding whether a man who divorces his wife three or more times in a single utterance causes the divorce to take effect as three, resulting in a major final separation for the woman, or whether it takes effect as one revocable divorce.
The correct view in this matter is that it counts as one revocable divorce. This is based on what is established in Sahih Muslim from Ibn 'Abbas (may Allah be pleased with him and his father), who said: "During the time of the Prophet (peace and blessings be upon him), the time of Abu Bakr, and two years of the caliphate of 'Umar (may Allah be pleased with him), a triple divorce was considered one divorce. Then 'Umar (may Allah have mercy on him) said: (The people have become hasty in a matter in which they used to be patient, so if we were to enforce it upon them), and he enforced it." Also, in Musnad Ahmad with a good chain of narration, from Ibn 'Abbas (may Allah be pleased with him and his father), that Abu Rakanah divorced his wife three times, so he grieved for her, and the Prophet (peace and blessings be upon him) returned her to him and said:.
The scholar Ibn al-Qayyim (may Allah have mercy on him) elaborated on this issue, preferred this opinion, and explained its evidence in his books: (Al-I'lam), (Zad al-Ma'ad), and (Ighathat al-Lahfan min Makayid al-Shaytan, and Ighathat al-Lahfan fi Talaq al-Ghadib). Whoever wishes to look into his words should refer to these books or whatever is available of them.
And success is from Allah, and may Allah send prayers and peace upon our master and our Prophet Muhammad, his family, and his companions.
And peace be upon you and the mercy of Allah and His blessings.
