From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz to the honorable brother, the virtuous Shaykh, the head of the court in Bisha, may Allah grant him success in all good, amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O beloved, your noble letter number (1850), dated 13/10/1388 AH, has arrived. May Allah guide you. I have reviewed what your virtue recorded regarding the manner of the divorce that occurred from the husband M. to his wife N. It is that he divorced her with three pronouncements using a single phrase, and then she clung to him, demanding a divorce in addition to that. He then said: "Talaq, talaq," and he intended by that to release her from him, not that he desired to separate from her. He stated that he did not divorce her except in that manner, and the woman confirmed this to him. Her father also testified that he was not present at the time of the divorce, but he confirms that no divorce had occurred from the husband to his wife prior to that.

Answer: Based on that, I issued a fatwa to the aforementioned husband that two divorces have occurred to the aforementioned wife by the divorce mentioned: one by the first divorce, and the second by the final divorce. The second phrase in the final divorce is considered a confirmation of the first phrase, so only one divorce takes effect by them, as the scholars have established, and as is not hidden. He may return to her with a new marriage contract with its conditions considered valid by the Shari'ah, because she has exited the waiting period. It is authentically reported from the Prophet (peace and blessings be upon him) what indicates the aforementioned fatwa, as is known to your virtue. I hope you will inform him that he must repent from his first divorce, because divorcing by three pronouncements is not permissible. I also hope you will inform everyone of what has been mentioned. May Allah reward you and guide your steps.
