Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz, to the honorable brother, the esteemed Shaykh, the head of the court in Bisha, may Allah guide him to all good, amen.
Peace be upon you, and the mercy of Allah and His blessings. After that:
O Beloved: Your noble letter number 2116, dated 29/10/1390 AH, has arrived, may Allah guide you, and I have reviewed the attached record, which contains: your confirmation of the nature of the divorce pronounced by the husband, H. N. R., upon his wife.
It states that he acknowledged to you that he divorced the aforementioned wife by saying: "Talaq, then talaq by three"; this was because he married another woman, and she conditioned it upon his divorcing the aforementioned woman, so he divorced her with the aforementioned divorce, and did not add anything to it, and no further divorce followed it, and he had not divorced her before this, and that he took her back on the night the divorce occurred, which was in the month of Jumada al-Thani, year 1390 AH. He provided two witnesses to this, and he brought the aforementioned witnesses before you, and they acknowledged what was mentioned.
And that her father acknowledged before you that his daughter came to him with her belongings (her household items), and did not mention to him anything about the divorce, and that he was not present at the divorce that occurred from her husband, and he knows nothing about it except from people, and that no divorce preceded it and no divorce followed it.
Answer: Based on this, I issued a fatwa to the aforementioned husband: that two divorces have occurred upon the aforementioned wife by his mentioned divorce: one by his saying "Talaq," and the second by his saying "then talaq by three," and he has one divorce remaining, and his taking her back is valid, and it is authentically reported from the Prophet (peace and blessings be upon him) what indicates this, as is not hidden.
So I hope you will inform everyone of the aforementioned fatwa, and order the husband to repent from his aforementioned divorce; because it is a reprehensible divorce—as your eminence knows.
May Allah reward you, and bless your efforts, and make us and you among those who assist in the affairs of truth; He is the best of those asked.
