Question: Q: If a woman is divorced after a period of marital defiance that lasted a year, two years, or less, and the period for purifying the womb has already passed before the divorce, is she required to observe the waiting period? Or is it permissible for her to marry without a waiting period? It is known that her husband divorced her in exchange for compensation and does not wish to take her back.

Answer: If a woman is divorced, the waiting period is obligatory for her after the divorce, even if the duration of her separation from her husband was long. This is based on the saying of Allah (Glorified and Exalted is He) :
Divorced women remain in waiting for three periodsوَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنفُسِهِنَّ ثَلاَثَةَ قُرُوَءٍ
[al-Baqarah:228]; and because the Prophet (peace and blessings be upon him) ordered the wife of Thabit ibn Qays, when she sought divorce from him in exchange for compensation, to observe the waiting period after the divorce for one menstrual cycle.
The correct view is that one menstrual cycle is sufficient for the woman who seeks divorce in exchange for compensation after the divorce; based on this noble hadith, which specifies the noble verse mentioned earlier.
