Question: To His Eminence the Shaykh / Abdul Aziz ibn Abdullah ibn Baz (may Allah preserve him)
Peace be upon you, and Allah’s mercy and blessings, and after that:
My father has a debt of seventy-nine thousand riyals with the Savings Bank (the Real Estate Fund). Since my father has grown old and no longer knows anything about his affairs, and he had entrusted me with all his wealth as his eldest daughter, may I pay it off from his money without the knowledge of his sons? They might prevent me from disposing of it on the grounds of postponing the payment after his death, as a preparation for the exemption that is not originally part of the bank's system, but is the jurisdiction of the Diwan, which has conditions for exemption that I do not see applied to our family. I fear that the period during which my father's estate is occupied will be prolonged, or that he will be kept from Paradise until his debt is paid.
I hope to receive a fatwa and advice from you: Am I permitted to dispose of it to clear his estate? Or, since he left behind a payment, may Allah forgive him? May Allah reward you with good.
And upon you be peace, and the mercy of Allah and His blessings. After that: You have no right to dispose of anything from his wealth except after referring to the court. May Allah guide them all.
