The first question of Fatwa No. ( 13045 )
Q1: My father passed away, and he had a sum of (580, five hundred and eighty riyals) owed to him by a certain person. That person came to me and gave me (500 riyals) and I forgave him the remaining eighty. The question is: Do I have the right to forgive this amount, and what is the ruling? Please note that the executor is my elder brother, who paid off many debts on behalf of my father. Is it permissible for me to release him from this debt, or does it belong to the heirs? Please give us a ruling, may Allah reward you with good.
A1: What your father left behind in terms of rights he had with people belongs to his heirs after his debts are paid and his lawful will is executed. Therefore, your forgiveness of the eighty riyals to the aforementioned person is not valid, unless the adult heirs permit it regarding their share. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
