Question: In the program (Nur 'ala al-Darb), which is a program that is widely distributed, the topic of this matter has been discussed. Since the mahr is named, it is obligatory to publish a general notice or a response to this statement: that it is not permissible. This is because some people act upon it; they hear this statement: that if there is a mahr, then it is permissible?

Answer: This is, in any case, an error. We must ask the one who said it, and we will agree with him on a matter, if Allah wills, to announce this thing. This is because it contains many harms, and if a person of reason reflects upon these issues, he will know the evil in them. Furthermore, it contradicts the explicit text of the Prophet (peace and blessings be upon him) and his general statement (peace and blessings be upon him). The statements of the scholars and their independent legal reasoning (may Allah be pleased with them and have mercy on them) are subjected to the Book and the Sunnah. Whatever of them agrees with the Book and the Sunnah is accepted, and whatever of their statements and opinions contradicts the Book and the Sunnah must be rejected. Allah the Exalted said:
And if you disagree over anything, refer it to Allah and the Messenger, if you should believe in Allah and the Last Day. That is the best [way] and best in result.فَإِن تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللّهِ وَالرَّسُولِ إِن كُنتُمْ تُؤْمِنُونَ بِاللّهِ وَالْيَوْمِ الآخِرِ ذَلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا
[al-Nisa: 59], and He the Exalted said:
And in anything over which you disagree - its ruling is [to be referred] to Allah.وَمَا اخْتَلَفْتُمْ فِيهِ مِن شَيْءٍ فَحُكْمُهُ إِلَى اللَّهِ
[al-Shura: 10].
This is the obligation of the people of knowledge: to refer what people dispute to the judgment of Allah and His Messenger, so that the dispute ends, and so that the Muslim community unites upon the truth and guidance that benefits them and does not harm them.
