Divorce conditional on a condition that does not take effect before the condition is fulfilled
Machine translationRead the Arabic original
Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz, to the honorable brother: I. M. A. May Allah grant him safety and take care of him, amen.
Peace be upon you, and the mercy of Allah and His blessings. After that:
Your letter dated 8/11/1392 AH has been received, may Allah guide you. It contained the information that a dispute arose between your mother and your wife, so your wife went to her home, where she began to cry, raised her hands to the sky, and said: "O Lord, as my husband's mother has done to me, let her sit in a corner and need me." Your agitation and anger increased greatly upon hearing this, so you responded to that by saying: "If that happens to my mother, you are divorced three times." You made this clear by saying: "Remember that if this happens, you are divorced three times." You fear that it may have taken effect, or that something may have occurred from you due to this speech, and you sought a fatwa, which was known.
And the answer: If your mother is afflicted with what was mentioned—may Allah protect us from it—then one divorce takes effect on your wife by your aforementioned words, and you may take her back immediately if you had not divorced her twice before that. May Allah protect everyone from the whispers of Satan.
And peace be upon you and the mercy of Allah and His blessings.
