Question:
What about the one who swears to abandon a sin and then returns to it?

Answer:
In that case, he owes the expiation, and he must repent in all cases. If he says, “By Allah, I will not smoke” or “I will not drink alcohol,” he has to fulfill the oath, because this is a right. He must refrain from the sin even if he had not sworn; it is obligatory for him to refrain from the sin even if he had not sworn. But if he swears, it strengthens the matter; what is obligatory for him becomes greater.
But if he breaks his oath and smokes or drinks alcohol, may Allah protect us from that, he must repent along with paying the expiation for the oath.
