Definition of Divorce.

The Shaykh : His statement that talaq is the release of the bond of marriage or part of it: this is talaq, which is the name of the verbal noun (masdar) for the verb talaka, yutaliq, tatlīqan and talaqan, just as one says kalama, yukallimu, what? taklīman and kalāman. Accordingly, talaq is a verbal noun because it contains the meaning of the verbal noun without its letters. In technical terminology, it is the release of the bond of marriage or part of it. The release of the bond of marriage applies if it is a final divorce, or part of it if it is a revocable divorce. This definition is not restrictive because it includes faskh (annulment). Therefore, the word "talaq" or what is equivalent to it in meaning must be added to it: "the release of the bond of marriage or part of it by the word talaq or what is equivalent to it in meaning", so that faskh is excluded from it, such as khul', separation due to a defect in the woman or a defect in the man, or the like.
