"And if he divorces her before consummation, she is entitled to a gift according to the means of her husband, whether he is wealthy or poor"

Machine translationRead the Arabic original
The Shaykh :"And if he divorces her before consummation, she is entitled to a gift according to the means of her husband, whether he is wealthy or poor" If he divorces her, meaning the wife, before consummation, or before seclusion, if he divorces her before that, she is entitled to a gift according to the means of her husband, whether he is wealthy or poor. The gift means that he gives her something to please her heart, because she currently has no mahr, since no mahr was specified for her. So if he divorces her before specifying a mahr for her, before consummating the marriage, and before secluding with her, she is entitled to a gift, meaning she is given what? Something to enjoy that pleases her heart, according to the ease or hardship. The wealthy man has a greater obligation than the poor man. This is to console her heart. However, if the mahr has been specified, for example, if it was said, "I have given you ten thousand as mahr," Allah the Exalted said:
And if you divorce them before you have touched them and you have already specified for them an obligation, then [give] half of what you specified
[Al-Baqarah 2:237]
In this case, half of the mahr is taken. The summary of the matter is that if a woman is divorced before consummation and seclusion, if a mahr has been specified for her, she is entitled to half of the mahr. If no mahr has been specified for her, she is entitled to a gift according to the means of the husband, whether he is wealthy or poor, as Allah the Exalted said:
the wealthy according to his capability and the poor according to his capability وَمَتِّعُوهُنَّ عَلَى الْمُوسِعِ قَدَرُهُ وَعَلَى الْمُقْتِرِ قَدَرُهُ
[Al-Baqarah 2:236]
