Q3: If a man marries and the husband confines the wife after taking possession of her for four years without having consummated the marriage, and after these four years have passed, he divorces this wife and marries another, knowing that the mahr is still in his possession and he has not paid part of the mahr, but the remainder was to be paid upon the completion of the marriage, does the Shari'ah grant the wife and her guardian the remaining rights with the husband from whom the divorce occurred and who married another, when there was not a month between the divorce and the marriage? I ask for information on this.
A3: If a man divorces his wife after the marriage contract and before consummating the marriage, it is obligatory for him to pay her half of the specified mahr, unless she forgives her right. If no mahr was specified for her and he did not consummate the marriage, she is entitled to a gift
in accordance with what is known, according to his condition of wealth or poverty. This applies whether he marries another or not, and whether the duration is long or short. If there is a dispute between them regarding this or anything else, the resolution lies with the Shari'ah court. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
