What is the ruling on the imam reading from the mushaf in obligatory prayer, and likewise in voluntary prayer?

Machine translationRead the Arabic original
The questioner: In this matter, we prayed 'Isha', and the imam was opening the mushaf and reading from it in the 'Isha' prayer?

The Shaykh: Strange, is he doing it now in the night prayer of Ramadan?

The questioner: So, before the prayer started, I almost objected, but...

The Shaykh: Ha, good sleep, come on, answer, Nati' is with them!! Ha, is he Algerian?!
The student: Their handwriting is terrible, terrible.

The Shaykh: Allahu Akbar! May Allah help them.
The student: It is a fitnah and a trial for them.

The Shaykh: They are colonized, colonized, enslaved, humiliated, yes.

The questioner: So the imam reads from the mushaf, and I almost objected, I mean.

Another questioner: Peace be upon you.

The questioner: But, I mean...

The Shaykh: Oh Shaykh, and upon you be peace, change your device, yes.

The questioner: So after the prayer ended, I mean, regarding the scholars sitting behind him, how is this? ? He said some scholars have permitted it. I said, I mean, does your statement mean that some scholars have not permitted it?! Is this in the obligatory prayer or the voluntary one?! There was no answer, I said, since there are those who permit it and those who do not, it is better that it not be done, and it is preferable that it not be done, especially in the obligatory prayer.

The Shaykh: Perfect.

The questioner: So, I mean, the matter, I mean, as if they...

Another questioner: They settled it.

The questioner: They settled it like that and left.

The Shaykh: Is this in Basra?
The student: Here in Masjid al-Nur.

The Shaykh: Al-Nur?!

The questioner: Abu 'Abd al-Rahman!

The Shaykh: May Allah guide you.

The questioner: What is your opinion about what is happening in Iraq?

The Shaykh: Yawash, yawash, as the Turk says.

The questioner: Hehe, this is an Iraqi word!

The Shaykh: Also Iraqi?! Let's say it a second time, as the people of Iraq say.

The questioner: What is the ruling?

The Shaykh: We do not see reading from the mushaf, even in voluntary prayer, even in the night prayer of Ramadan!

The questioner : May Allah reward you with good.

The Shaykh: We believe that what is done in Saudi Arabia in general, and in the Sacred Mosque in particular, of newly invented matters: that the imam holds this mushaf and reads from it, this phenomenon did not exist originally in the time of the Salaf, and naturally, the disagreement that the man who asked me pointed out is not hidden from me.

The questioner: I did not ask him.

The Shaykh : Yes?

The questioner: I did not ask him as a question because I knew him previously.

The Shaykh: Ah, you know him, the important thing is that the matter indeed has disagreement, both old and new, and those who permit it, as you know, permit it in voluntary prayer and especially in the night prayer of Ramadan.

The questioner: Yes.

The Shaykh: Their only proof is "that a boy or slave of 'A'ishah used to lead her in prayer from the mushaf," this is all that is narrated on the subject, and such a thing is not permissible in fiqh to be made a general sunnah, from here we say that this which has become widespread in this time in those lands and these lands, especially in Ramadan, is first among the newly invented matters, and second: I look at his saying - peace and blessings be upon him - :
Deeds are only by their endings إنما الأعمال بالخواتيم
, and he said this in the general life of a person, where he fluctuates between dying wicked, God forbid, or righteous, so he says
Deeds are only by their endings إنما الأعمال بالخواتيم
, I understand from this phrase a meaning broader than the occasion for which it was said, until I read in some books, these which they call sacred books, and they were sacred before the distortion and change and alteration, but they contain remnants of wisdom, among them: "that 'Isa - peace be upon him - preached and counseled the disciples one day, and told them that false prophets would come to them and a messenger would come who brings good news of him, Ahmad, he is the last of the prophets, they said to him: how do we know the truthful from the liar? So he answered with the following wisdom, which is the place of citation: 'By their fruits you will know them'" , so I take this Gospel wisdom and benefit from it in addition to what preceded from the hadith:
Deeds are only by their endings إنما الأعمال بالخواتيم
, I see if there is a matter in which the jurists disagreed on two opinions and there are no clear proofs, but if there are clear proofs, there is no need for hesitation, ah, but there are no clear proofs except that one of the opinions has bad effects, and one of them prevents these bad effects by adopting the second opinion over the first, so now, among the effects of permitting the imam to read from the mushaf is neglecting the care of memorizing the Qur'an.

The questioner: Yes.

The Shaykh: Hey, "by their fruits you will know them," so this fatwa will lead to an ignorant person leading the people, and therefore I will hold the mushaf and read from it.
