The Shaykh : So, whoever abandons prayer is a disbeliever, and this entails worldly matters and matters of the Hereafter. The worldly matters are: first, he is called to pray; if he prays, well and good, otherwise he is killed. It is obligatory for the rulers, and if they neglect this, Allah will question them when they stand before Him, because every Muslim who apostatizes from Islam is called to it; if he returns, well and good, otherwise he is killed. The Prophet (peace and blessings be upon him) said: Sunan Ibn Majah 2535Sahih (Darussalam)
Second, he is not to be married if he proposes; and if he is married, the contract is invalid, and the woman is not lawful for him to have intercourse with, for he would be having intercourse with a foreign woman, may Allah protect us from that, because the contract is not valid, due to the saying of Allah the Exalted:[Al-Mumtahanah 60:10] Third, he has no guardianship, not over his children, nor over his sisters, nor over any of the people, because a disbeliever cannot ever be a guardian over a Muslim, not even his daughter. Suppose a man marries and grows old and has daughters, and then he stops praying, may Allah protect us from that; he cannot marry off his daughter, he cannot marry off his daughter.
But if someone says, "This is difficult; there are people now who have daughters and they do not pray; what do we do?" We say: in such a case, if it is not possible to avoid having the marriage contract concluded for the daughters, then the husband should leave it to her brother, if she has an adult older brother, to conclude it for him secretly so that it becomes lawful for him, or her uncle, for example, or one of her 'asabah (residuary male heirs), the closest to the closest according to the order of guardianship, until he marries his wife with a valid contract. As for the contract of her father for her, while he is an apostate disbeliever, it is not valid, it is not correct; even if he were to conclude it a thousand times, it would be of no value. And, if Allah wills, the remaining rulings on this matter will come.
