The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful:
We have previously discussed several verses regarding the sanctity of the rights of Muslims, being gentle with them, and doing good to them. Among the verses that explain the sanctity of the Muslim is the saying of Allah the Exalted:
whoever kills a soul unless for a soul or for corruption [done] in the land - it is as if he had slain mankind entirely. And whoever saves one - it is as if he had saved mankind entirely مَن قتل نفساً بغير نفسٍ أو فسادٍ في الأرض فكأنما قتل الناس جميعاً ومن أحياها فكأنما أحيا الناس جميعاً
[Al-Ma'idah 5:32]
. Allah made clear in this verse that whoever kills a soul without a soul or for corruption in the land is as if he has killed all of mankind, because the sanctity of Muslims is one. Whoever violates the sanctity of one Muslim is as if he has violated the sanctity of all Muslims. Just as whoever lies to one messenger is as if he has lied to all messengers. For this reason, read the saying of Allah the Exalted:
The people of Noah denied كذبت قوم نوح
[Ash-Shu'ara 26:105]
What is it?
The messengers المرسلين
, even though they did not lie to more than one. No messenger was sent before Noah, and those after Noah were not reached by his people. But whoever lies to a messenger is as if he has lied to all messengers. And whoever kills a protected soul is as if he has killed all of mankind, because the sanctity of Muslims is one.
and whoever saves a life ومن أحياها
means: he strives to save it and rescue it from destruction.
it is as if he had saved mankind entirely فكأنما أحيا الناس جميعاً
[Al-Ma'idah 5:32]
: Saving it and rescuing it from destruction sometimes involves a destruction that a person has no power over from Allah, such as a fire breaking out in a man's house, and you try to save him and you do save him. This is saving a life.
As for the second type: it is what a person has power over, such as a man attempting to aggress upon a person to kill him, and you intervene between them and protect him from being killed. You have now saved a life
it is as if he had saved mankind entirely فكأنما أحيا الناس جميعاً
[Al-Ma'idah 5:32]
, because saving one Muslim is like saving all of mankind.
And His saying, Mighty and Majestic:
except for a life بغير نفس
: It is derived from this that whoever kills a soul for a soul is excused and there is no blame on him. Allah the Exalted said:
And We ordained for them therein a life for a life وكتبنا عليهم فيها أن النفس بالنفس
[Al-Ma'idah 5:45]
. So if a person kills a soul with a right, meaning for another soul, there is no blame on him and no sin on him, and he inherits from the killed person. The killer inherits from the killed person if he killed him with a right. And the killer does not inherit from the killed person if he killed him without a right. Let us give an example of this with three brothers. The eldest of them intentionally killed the youngest. Who inherits from the youngest? His middle brother inherits from him, and his eldest brother does not inherit from him. Why? Because he killed him without a right. Then the middle brother demanded the blood of his younger brother, so he killed his eldest brother in retaliation. Does the middle brother inherit from him? Does he inherit from his eldest brother? He inherits. Why, when he is the one who killed him? Because he killed him with a right. And the first one, the eldest who killed the youngest, does not inherit because he killed without a right.
So killing with a right has no blame and has no effect. Retaliation,
And there is for you in legal retribution [saving of] life, O you [people] of understanding, that you may become righteous. ولكم في القصاص حياة يا ألي الألباب لعكم تتقون
[Al-Baqarah 2:179]

And His saying, Mighty and Majestic:
or for corruption [done] in the land أو فسادٍ في الأرض
[Al-Ma'idah 5:32]
: Corruption in the land does not mean that a person unleashes a bulldozer to demolish a house, even if it is aggression. This is not corruption, or even if it is corruption, it does not make the blood of a Muslim lawful. Corruption in the land is: spreading bad ideas, or evil beliefs, or cutting off roads, or promoting narcotics, or the like of that. This is corruption in the land. So whoever corrupts in the land in this manner, his blood is wasted and lawful to be killed, because he is one who strives in the land for corruption. Indeed, Allah said in Surat al-Ma'idah, in the same surah, He said:
Indeed, the penalty for those who wage war against Allah and His Messenger and strive upon earth [to cause] corruption is none but that they be killed or crucified or that their hands and feet be cut off from opposite sides or that they be exiled from the land إنما جزاء الذين يحاربون الله ورسوله ويسعون في الأرض فساداً أن يقتَّلوا أو يصلَّبوا أن تقطع أيديهم وأرجلهم من خلاف أو ينفوا من الأرض
[Al-Ma'idah 5:33]
: According to the severity of their crime. If it is major, then by killing. If it is less than that, then by crucifixion. If it is less than that, then by cutting off their hands and feet from opposite sides, cutting off the right hand and the left foot. If it is less than that, then by being exiled from the land: either by imprisonment for life, as some scholars said, or by expulsion from the cities, as others said. But if their evil cannot be averted by expelling them from the cities, they are imprisoned. They are imprisoned until death.
So the conclusion is that whoever kills a soul to corrupt in the land has no blame. Indeed, killing a soul to corrupt in the land is obligatory. And killing a soul for a soul is permissible, except according to the opinion of Imam Malik (may Allah have mercy on him) and Shaykh al-Islam Ibn Taymiyyah, for whom killing by ambush is obligatory. Retaliation is obligatory for it. Meaning, whoever kills a person by ambush, meaning he takes him by surprise until he kills him, he is killed even if the guardians of the killed person pardon him. Because ambush is evil and corruption from which one cannot escape. For example, a person comes to another person while he is sleeping and kills him. This person is killed in any case, even if the guardians of the killed person say: We pardon you and we want nothing. He is killed. This is the opinion of Imam Malik and Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him), and it is the truth. This statement is the truth: that if he kills by ambush, he must be killed, and the guardians of the killed person have no choice in that.
So the conclusion is that Allah made clear in this verse that killing one soul without a soul or for corruption in the land is like killing all of mankind, and saving one life is like saving all of mankind. And this indicates the greatness of killing. If a person were to count how many of the children of Adam have been killed without a right, can he do it? Yes?
The student: He cannot count it.

The Shaykh : He cannot count it. Every soul that is killed, upon the first son of Adam who killed his brother is a share of its sin. Upon him is the sin. The son of Adam who killed his brother killed him out of envy. They offered two sacrifices from the children of Adam, the first offspring, meaning the first generation. They offered two sacrifices as an offering to Allah, so Allah accepted from one and did not accept from the other. So the second one, from whom Allah did not accept, said to his brother:
I will surely kill you لأقتلنك
Why does Allah accept from you and not from me? Envy, or with a right? Envy. Acceptance is with Allah. So his brother said to him: Only the righteous will be accepted by Allah. Meaning: Fear Allah, and Allah will accept from you. But is the one who threatens his brother with killing a person who fears Allah? No. In the end, he killed him, may Allah protect us.
And his soul permitted to him the murder of his brother, so he killed him and became among the losers. طوَّعت له نفسه قتل أخيه فقتله فأصبح من الخاسرين
[Al-Ma'idah 5:30]
He lost, may Allah protect us. And it is said that he continued to carry his brother whom he killed on his back for forty days, not knowing what to do with him, because graves were not legislated at that time. So Allah sent a crow. Allah sent a crow to scratch in the earth, meaning with its claws,
to show him how to hide the disgrace of his brother ليريه كيف يواري سوءة أخيه
[Al-Ma'idah 5:31]
. And it is said that two crows fought, and one killed the other, so one of them dug for the other and buried him. So this killer followed his example and buried his brother. And this is one of the wonders: that the one who taught us burial was whom?
The student: The crows.

The Shaykh : The crows. The crows are the ones who taught us burial. In any case, I say: this man who killed his brother, every soul that is killed without a right, upon the first killer, may Allah protect us, is a share of its sin. And likewise, whoever initiates killing after people have been safe, and starts assassinating people and the like of that, and people become bold to do this because of his action, then he has a share of their sin. Because he was the cause of violating this. For example, those who in the past used to hijack planes. It passed over us for years that plane hijackings were frequent. A plane would be hijacked twice or three times a year. But praise be to Allah, now it has decreased. The first one who hijacked planes, every sin that occurred in the hijacking of planes, he has a share of it. Because he was the one who initiated it:
And whoever introduces a bad practice, he will bear its sin and the sin of everyone who acts in accordance with it until the Day of Resurrection. ومن سن سنة سيئة فعليه وزرها ووزر من عمل بها إلى يوم القيامة
As-Sunan al-Kubra lil-Nasa'i 12:118
. We ask Allah to make us and you among the callers to good and its doers, for He is Generous and Bountiful.
