Answer:
No, that is a mistake. One who displays religious innovations is not subject to backbiting, and one who displays open sinfulness is not subject to backbiting. Backbiting applies to one whose speech is concealed, who has not displayed it, whose bad deeds he has not displayed. But if he displays them, it is no longer backbiting.
Backbiting is mentioning someone with something he has not made public. As for one who displays evil and open sinfulness, there is no backbiting regarding what he has displayed. Allah (Mighty and Majestic) said in His great Book:
Allah does not like the public mention of evil except by one who has been wrongedلَا يُحِبُّ اللَّهُ الْجَهْرَ بِالسُّوءِ مِنَ الْقَوْلِ إِلَّا مَنْ ظُلِمَ
[Al-Nisa: 148], and the Prophet (peace and blessings be upon him) said:
All the sins of my followers will be forgiven except those of the Mujahirinكل أمتى معافى إلا المجاهرين
Sahih al-Bukhari 6069
. When a man with no good in him entered upon him, he said:
What a bad brother of the tribe he isبئس أخو العشيرة
, and in another wording he said:
What a bad son of the tribe, allow him to enterبئس ابن العشيرة، ائذنوا له
. And when a bad funeral passed by him and they spoke ill of it, he said:
The Fire is obligatory for itوَجَبَتْ لها النار
They spoke ill of it regarding what was apparent from it, and he did not rebuke them for that. This indicates that one who displays evil is not subject to backbiting.
