Question:
I had a disagreement with my colleague at work; so I swore that I would not eat or drink in his house. One time I went with him to his home and ate some fruit while forgetful. After I left, I remembered that I had sworn an oath. I hope for your guidance. After the expiation, should I eat and drink in his house or not?

Answer:
If you were forgetful, then you owe nothing, meaning you do not owe an expiation. However, it is better that you eat with your brother if he is good. And you should offer an expiation—if this friend is good in his religion—it is better that you offer an expiation and return to eating in his house. As for if he is not good, then praise Allah for this oath, do not eat with him, do not visit him, and stay away from him. If he is one who displays sins and calls to sins, then praise Allah for staying away from him. But if he is good, then you offer an expiation for your oath: you feed ten poor people, or clothe them—and praise be to Allah—and you go to your brother and eat in his house.
The Prophet (peace and blessings be upon him) said:
and whenever you take an oath to do something and later you find that something else is better than the first, then do the better one and make expiation for your oath.إذا حلفت على يمين فرأيت غيرها خيرًا منها، فكفر عن يمينك، وأت الذي هو خير
Sahih al-Bukhari 6622
, and he (peace and blessings be upon him) said:
By Allah, Allah willing, if I ever take an oath, and then see that another is better than the first, I make expiration for my (dissolved) oath, and do what is better and make expiration.والله إني -إن شاء الله- لا أحلف على يمين فأرى غيرها خيرًا منها، إلاَّ كفرت عن يميني وأتيت الذي هو خير
