Combining the Prohibition of Burial During Three Times with the Expediency of the Funeral Prayer
Machine translationRead the Arabic original
Question:
How do we reconcile the Prophet’s (peace and blessings be upon him) prohibition of praying and burying during three specific times with the hadith regarding the expediency of the funeral prayer, especially if the funeral occurs, for example, after the Asr prayer? Please inform us, may Allah reward you with good.
Answer:
There is no contradiction between the two hadiths. The Sunnah is to expedite the prayer over the deceased and his burial, based on the saying of the Prophet (peace and blessings be upon him):Sunan Abi Dawud 3181Sahih (Al-Albani).
However, if this coincides with the time of the three hours, the prayer over the deceased and his burial are delayed, based on the statement of 'Uqbah ibn 'Amir (may Allah be pleased with him) :Bulugh al-Maram 2:15, narrated by Muslim in his Sahih.
These three hours are all brief, and there is no harm in delaying the prayer over the deceased or his burial during them.
Allah (Glorified and Exalted is He) has the perfect wisdom in this, and He (Glorified and Exalted is He) is the Most Merciful of the merciful and the Most Wise of the judges. And success is from Allah.

Answer:
There is no contradiction between the two hadiths. The Sunnah is to expedite the prayer over the deceased and his burial, based on the saying of the Prophet (peace and blessings be upon him):
Walk quickly with a funeral, for if the dead person was good it is a good condition to which you are sending him on, but it he was otherwise it is an evil of which you are riding yourselves.
أسرعوا بالجنازة فإن تك صالحة فخير تقدمونها إليه، وإن تك سوى ذلك فشر تضعونه عن رقابكمHowever, if this coincides with the time of the three hours, the prayer over the deceased and his burial are delayed, based on the statement of 'Uqbah ibn 'Amir (may Allah be pleased with him) :
There are three times at which Allah's Messenger (ﷺ) used to forbid us to pray or bury our dead: (a) when the sun begins to rise till it is fully up, (b) when the sun is at its height at midday till it passes the meridian, and (c) when the sun draws near to setting
