Hastening the burial of the deceased

Machine translationRead the Arabic original
The third question of Fatwa No. ( 20123 )
Q 3: Is it better to hasten the burial of the deceased or to wait until the people gather and one of the obligatory prayers is present , and may Allah reward you with good.
A 3: The Sunnah is to hasten the preparation of the deceased, shrouding him, and praying over him, even if it is not at the time of an obligatory prayer, provided that there are enough people to pray over him. This is indicated by what Sa'id ibn al-Musayyib narrated from Abu Hurayrah (may Allah be pleased with him), from the Prophet (peace and blessings be upon him), who said:
Walk quickly with a funeral, for if the dead person was good it is a good condition to which you are sending him on, but it he was otherwise it is an evil of which you are riding yourselves.أسرعوا بالجنازة، فإن تك صالحة فخير تقدمونها إليه، وإن تك سوى ذلك فشر تضعونه عن رقابكم
Sunan Abi Dawud 3181Sahih (Al-Albani)
It is agreed upon, and this is the wording of al-Bukhari (Vol. 2, p. 88). If the time of the obligatory prayer is near, it is delayed so that he is prayed over in the mosque at the time of one of the obligatory prayers for the benefit of increasing the number of people praying over him, and there is no harm to the deceased in that, so there is nothing wrong with it; rather, that is better and more appropriate. This is based on what Ibn 'Abbas (may Allah be pleased with them both) narrated, saying: I heard the Messenger of Allah (peace and blessings be upon him) say:
If any Muslim dies and forty men who associate nothing with Allah stand over his prayer (they offer prayer over him), Allah will accept them as intercessors for him.ما من رجل مسلم يموت فيقوم على جنازته أربعون رجلاً لا يشركون بالله شيئًا إلا شفعهم الله فيه
Sahih Muslim 948
It was narrated by the Imam Muslim in his (Sahih) and Abu Dawud in his Sunan, and in a narration from him from 'A'ishah (may Allah be pleased with her):
If a company of Muslims to the number of a hundred pray over a dead person, all of them interceding for him, their intercession for him will be accepted.ما من ميت تصلي عليه أمة من المسلمين يبلغون مائة كلهم يشفعون له إلا شفعوا فيه
Mishkat al-Masabih 1661
There is no contradiction between the two narrations, for Allah informed His Prophet (peace and blessings be upon him) about those who pray over a deceased person, one hundred of them, and then Allah the Exalted added favor by the fact that such a reward is obtained for those who pray over him, forty men. The implication of the number is not a proof according to the majority of scholars of usul al-fiqh, so the information about the acceptance of the intercession of one hundred does not necessitate the rejection of the intercession of fewer than that, and the favor of Allah is vast. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
