Question:
Is it permissible to speak with someone who has committed unlawful sexual intercourse and has not yet repented?
Answer:
Whoever commits open sins, such as unlawful sexual intercourse, intoxicants, usury or interest, smoking, letting a garment hang below the ankles, shaving the beard, and other sins, it is obligatory to advise him, command him to do what is right, and forbid him from doing what is wrong, with wisdom and good exhortation, and to argue with that which is best; for Allah (Glorified and Exalted is He) said: : [Surat al-Tawbah: 71], and He (Mighty and Majestic) said: [Surat Al Imran: 110].
Imam Ahmad and others narrated with a sound chain from Abu Bakr al-Siddiq (may Allah be pleased with him) that he addressed the people after the death of the Prophet (peace and blessings be upon him), saying: "O people, you recite this verse and place it in the wrong context. It is the saying of Allah, Glorified and Exalted: [Al-Ma'idah: 105]. And I heard the Messenger of Allah (peace and blessings be upon him) say: Musnad Ahmad 1Sahih (Darussalam)."
It is derived from this noble hadith and from this sermon of Abu Bakr al-Siddiq (may Allah be pleased with him) : that whoever does not enjoin good and forbid evil, while having the ability to do so, does not possess complete guidance; rather, his guidance is deficient. Allah has criticized and cursed the disbelievers among the Children of Israel for their disobedience, their transgression of the sanctities of Allah, and their failure to refrain from evil, in His saying, Glorified is He:[Al-Ma'idah 5:78] "They did not refrain from the evil they used to do. Evil was what they used to do" [Al-Ma'idah: 78-79].
It is authentically reported from the Messenger of Allah (peace and blessings be upon him) that he said:Sahih Muslim 49a. Muslim narrated it in his Sahih from the hadith of Abu Sa'id al-Khudri (may Allah be pleased with him) . Muslim also narrated in his Sahih from Abu Mas'ud (may Allah be pleased with him) from the Prophet (peace and blessings be upon him) that he said: Sahih Muslim 50a.
The hadiths regarding enjoining good and forbidding evil are very numerous. [Al-Ma'idah: 2], and His saying (peace be upon him) : "Indeed, mankind is in loss, except for those who have believed and done righteous deeds and advised each other to truth and advised each other to patience" [Al-Asr: 1-3].
Forbidding evil by hand is the duty of the rulers and the specific bodies appointed by the ruler for this purpose, and of a man with his family members, including his children and others, and of everyone who has authority over one who commits evil. As for others, they must forbid evil by tongue and heart to the extent of their ability, based on the aforementioned hadith of Abu Sa'id (may Allah be pleased with him) , and the saying of Allah (peace be upon him) : [Al-Taghabun: 16].
And I ask Allah to guide all Muslims, both rulers and the ruled, to everything that brings His pleasure, to rectify their hearts and their deeds, to grant them understanding in the religion, to support truth and its people through them, and to cause falsehood and its people to fail through them. Indeed, He is capable of all things, and He (Mighty and Majestic) is the One who grants success, and there is no power or strength except by Him.
