Continuation of the explanation of the hadith: “A woman from the tribe of Jahinah came to the Prophet (peace and blessings be upon him) while pregnant from zina, and she said…”

Machine translationRead the Arabic original
The Shaykh : And upon his family and companions, and she was pregnant from zina. “Pregnant” means she was carrying a child conceived through zina. She said: “O Messenger of Allah, I have committed a crime for which the hadd applies, so enforce it upon me”. She wanted the Messenger of Allah (peace and blessings be upon him and his family) to enforce the hadd upon her. Her hadd was to be stoned to death because she was a married woman. So the Prophet (peace and blessings be upon him) called her guardian and said to him:
Treat her well and bring her to me after delivery. أحسن إليها فإذا وضعت فأتني بها
Riyad as-Salihin 913
Then she was brought to the Messenger (may Allah’s peace and blessings be upon him) after she had given birth. Then he ordered her to wait until she weaned the child. When she had weaned him, she came, and the hadd was enforced upon her. He ordered that her clothes be tied tightly around her, meaning bound and secured, so that she would not move during the stoning and her private parts would be exposed. So her clothes were tied tightly around her, and then she was ordered to be stoned. He (may Allah’s peace and blessings be upon him) prayed over her. In this is evidence that the people of the deceased and those who handle the funeral are to be advised to treat the deceased with kindness and gentleness, and other things that suit his condition, as the Prophet (peace and blessings be upon him and his family) did. In this hadith is evidence that it is not required for the confession of zina to be repeated four times, and that if the one who commits zina confesses, even once, and he is sane with no confusion in his condition, then he is held to his confession and the hadd is enforced upon him. In this is evidence that it is required in enforcing the hadd that the harm not extend to anyone other than the one being punished, because if she had been stoned, the one in her womb would have died, and he had not committed a crime. For this reason, the Prophet (may Allah’s peace and blessings be upon him) ordered her to wait until she gave birth to the child and until she weaned him. In this is evidence that a woman is not dug into for stoning, but her clothes are tied around her, and then she is stoned with stones, meaning thrown with stones that are neither small nor large, until she dies. The hadd was like this because the forbidden desire encompassed the entire body, so it was fitting that the entire body taste the pain of the punishment. This is among the wisdom of Allah (Mighty and Majestic). In this is evidence that when the hudud are enforced, the person is absolved of them, purified from them, and cleansed of them. For this reason, the Prophet (peace and blessings be upon him) ordered her to be prayed over, and he prayed over her, and the people prayed over her. And Allah grants success.
