There is a third category: a wicked, rebellious, licentious person who speaks about unlawful sexual intercourse in boasting, and I seek refuge in Allah. He says: I traveled to such-and-such a country and committed fornication and did so, and committed unlawful sexual intercourse with several women, and the like of that, and he boasts with this. This person must be asked to repent, and if he repents, otherwise he is killed. Because the one who boasts about unlawful sexual intercourse, the implication of his state is that he has deemed unlawful sexual intercourse permissible, and I seek refuge in Allah. And whoever deems unlawful sexual intercourse permissible is a disbeliever, a disbeliever. And there are some people who do this, and I seek refuge in Allah. Some of these wicked, licentious people who the Muslims have been afflicted with calamities because of them, and because of their actions, there are those who brag about this matter. If he travels to a country known for wickedness and licentiousness, such as Bangkok and other vile countries that are full of unlawful sexual intercourse, sodomy, intoxicants, and the like, he returns to his companions bragging about what he did. This, as I said: he must be asked to repent, and if he repents, otherwise he is killed. Because whoever deems unlawful sexual intercourse or any of the apparent forbidden matters upon which there is consensus permissible, he becomes a disbeliever.
If someone says: Is it better for a person who commits unlawful sexual intercourse to go to the judge to confess to him so that the fixed punishment is enforced upon him, or is it better for him to cover himself? The answer to this is: that there is a detail in this. It may be that the person has repented with a sincere repentance, and he has regretted, and he knows from himself that he will not return to it. So it is better for him not to go, and not to inform about himself, but rather to keep the matter a secret between him and Allah. And whoever repents, Allah accepts his repentance. But as for the one who fears that his repentance will not be sincere, and fears that he will return and go back to the sin again, so it is better for him to go to the one in authority, to the judge or other, to confess to him so that the fixed punishment is enforced upon him. So this matter has a detail in it, and the rest of the speech on the hadith will come, if Allah wills.
