He said, may Allah have mercy on him: "Chapter on the permissibility of cursing the perpetrators of sins who are not specifically identified. It is established in the authentic collections that the Messenger of Allah (peace and blessings be upon him) said
Allah cursed him who changed the minarets (the boundary lines) of the land. لعن الله من غير منار الأرض

The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful.
This chapter was established by al-Nawawi, may Allah have mercy on him, in *Riyad al-Salihin* to clarify that cursing that is not directed at a specific person is permissible. He mentioned examples of this, three of which have already been mentioned, and today we will take three more from them.
The statement of the Prophet (peace and blessings be upon him) that the Prophet (peace and blessings be upon him) cursed the one who alters the landmarks of the earth, meaning its boundaries. For example, if a person has a neighbor and that person enters from his neighbor's land onto his own land, expanding his land and narrowing his neighbor's land, then he is cursed, as the Prophet (peace and blessings be upon him and his family) cursed him. It is established from him (peace and blessings be upon him) that
He who wrongly took a span of land, Allah shall make him carry around his neck seven earths. من اقتطع شبرا من الأرض ظلما طوقه الله به يوم القيامة من سبع أراضين

And if this applies to the one who alters the boundaries of the land, meaning the markers, how much more so for the one who takes the entire land and seizes it, refuge with Allah, for he is more deserving of the curse and expulsion from the mercy of Allah. There are people who encroach upon the lands of others, taking them unjustly and claiming they are theirs, and they may bring false witnesses to testify for them, so they are ruled in their favor. They fall under the curse, and on the Day of Resurrection they will come with it as a collar around their necks. We ask Allah for safety from it, O servants of Allah.
And from that, the Prophet (peace and blessings be upon him)
May Allah curse the thief! He steals an egg and his hand is cut off, and he steals a rope and his hand is cut off لعن السارق يسرق البيضة فتقطع يده ويسرق الحبل فتقطع يده

The thief is the one who takes money secretly from a secure place, such as coming at night or when people are unaware, opening doors and stealing. If this thief steals the minimum threshold, which is a quarter of a dinar or its equivalent in dirhams or goods, his hand is cut off, his right hand from the joint of the palm, by the saying of Allah the Exalted:
[As for] the thief, the male and the female, amputate their hands in recompense for what they committed as a deterrent [punishment] from Allah. And Allah is Exalted in Might and Wise. والسارق والسارقة فاقطعوا أيديهما جزاءا بما كسبا نكالا من الله والله عزيز حكيم
[Al-Ma'idah 5:38]
There is no difference between the thief being noble or lowly, or male or female, because the Prophet (peace and blessings be upon him)
He ordered the cutting off the hand of the woman from the Khazraj tribe who used to borrow goods and then deny it, so the Prophet (peace and blessings be upon him) ordered her hand to be cut off. This distressed the Quraysh, and they sought someone to intercede for her with the Messenger (peace and blessings be upon him). They asked Usamah ibn Zayd to intercede for the lifting of the punishment from her. So the Prophet (peace and blessings be upon him) stood up and said: "Only those before you were destroyed because when a noble person among them stole, they left him alone, and when a lowly person among them stole, they established the punishment upon him. By Allah, if Fatimah, the daughter of Muhammad, had stolen, I would have cut off her hand." أمر بقطع يد المرأة المخزومية التي كانت تستعير المتاع فتجحده فأمر النبي صلى الله عليه وسلم أن تقطع يدها فأهم قريشا ذلك وطلبوا من يشفع لها إلى الرسول عليه الصلاة والسلام فطلبوا من أسامة بن زيد أن يشفع برفع العقوبة عنها فاختطب النبي عليه الصلاة والسلام وقال إنما من أهلك من قبلكم أنهم كانوا إذا سرق فيهم الشريف تركوه وإذا سرق فيهم الوضيع أقاموا عليه الحد وأيم الله لو أن فاطمة بنت محمد سرقت لقطعت يدها
So he (peace and blessings be upon him) swore that if his daughter Fatimah, the most noble of women in lineage, had stolen, he would have cut off her hand. But this hadith that al-Nawawi, may Allah have mercy on him, referred to in *Riyad al-Salihin* says "steals an egg," and an egg does not reach the minimum threshold for theft, because the minimum threshold for theft is a quarter of a dinar. So how can it be said
He steals an egg and his hand is cut off, and he steals a rope and his hand is cut off يسرق البيضة فتقطع يده ويسرق الحبل فتقطع يده

Some scholars said that the egg referred to here is the helmet that a person places on his head during battle to protect him from arrows, which is valuable and equals a quarter of a dinar or more. And the rope referred to is the rope of ships, which is tied in the harbor so that the waves do not take it, and it is also valuable. Other scholars said that the egg referred to is a chicken egg, because the Prophet (peace and blessings be upon him and his family) used the general term, and when "egg" is used generally, only a chicken egg is understood. And the rope is the rope used to tie firewood and the like. But the Messenger (peace and blessings be upon him) said his hand is cut off, because if he becomes accustomed to stealing small things, he will dare to steal valuable and expensive things, so his hand is cut off. And this is closer to the truth: that the thief, refuge with Allah, if he steals a small thing, he will dare to steal a large thing, so his hand is cut off.
The third: He said that the Prophet (peace and blessings be upon him)
May Allah curse the one who curses his parents. لعن من لعن والديه
Whether it is the mother or the father, he says to his father, "May the curse of Allah be upon you," or to his mother. But the Companions (may Allah be pleased with them)
They said: "O Messenger of Allah, does a man curse his parents?" قالوا يا رسول الله أيلعن الرجل والديه
This is something that cannot be. He said
Yes, one abuses the father of another man, who in turn abuses his father. One abuses his mother and he in turn abuses his (the former's) mother. نعم يسب أب الرجل فيسب أباه ويسب أمه فيسب أمه

Meaning two people dispute, and one says to the other, "May Allah curse your parents," and the second says, "No, you, may Allah curse your parents." Since he was the cause of the other cursing his parents, he was given the ruling of the one who directly cursed his parents. These are three things that the Messenger (peace and blessings be upon him) cursed. But is it possible to come to a specific person, other than regarding the boundaries of the land, and say, "May Allah curse you"? The answer is no, it is not permissible to curse him if he is specifically identified. Or if you hear a person cursing his parents, you say, "May Allah curse you"? It is not permissible, this is forbidden. But you say to him, "Fear Allah, for Allah has cursed the one who alters the landmarks of the earth." And you say to the second, the thief, "Fear Allah, for the Messenger (peace and blessings be upon him) cursed the thief who steals an egg and a rope." And you say to the third, "Fear Allah, do not curse your parents, do not be the cause of their being cursed, for the Prophet (peace and blessings be upon him) cursed the one who curses his parents." As for specifying him by name and saying, "May Allah curse you" or "You are cursed," this is forbidden and not permissible, because it distinguishes between the general and the specific. And success is from Allah.
