Q: from: Y. R. M - From the news, you say: There are some pregnant women who experience miscarriage, and among the fetuses, some have completed their creation, while others have not yet completed it. So I ask your Eminence to clarify how to perform the prayer in both cases.

A: If a woman miscarries something in which the creation of a human being is evident, such as a head, a hand, a leg, or something else, she is in a state of post-natal bleeding, and the rulings of post-natal bleeding apply to her. She does not pray or fast, and it is not permissible for her husband to have intercourse with her until she becomes pure or completes forty days.
And when she becomes pure in less than forty days, it is obligatory for her to perform the full ritual bath, pray, and fast in Ramadan, and it becomes permissible for her husband to have intercourse with her.
There is no minimum limit for post-natal bleeding, so if she becomes pure after ten days or less or more have passed since the birth, it is obligatory for her to perform the full ritual bath, and the rulings of those who are pure apply to her as mentioned before. Any blood she sees after the forty days is blood of corruption; she fasts and prays with it, and it is permissible for her husband to have intercourse with her.
And I perform the ablution for every prayerوتوضئي لكل صلاة

And when the blood coming out of her after the forty days coincides with the time of menstruation -I mean: the monthly cycle- it has the ruling of menstruation for her, and prayer and fasting become forbidden for her until she becomes pure, and intercourse becomes forbidden for her husband.
As for if what comes out of the woman does not show the creation of a human being, such as if it is a piece of flesh with no features, or if it is blood, then she has the ruling of a woman with irregular bleeding, not the ruling of a woman with post-natal bleeding or the ruling of a menstruating woman. She must pray and fast in Ramadan, and it is permissible for her husband to have intercourse with her. She must perform the ablution for the time of every prayer, while protecting herself from the blood with cotton or the like, like a woman with irregular bleeding, until she becomes pure. It is permissible for her to combine the two prayers of Zuhr and 'Asr, and Maghrib and 'Isha', and it is prescribed for her to perform the full ritual bath for the two combined prayers and for the Fajr prayer; because of the hadith of Humaynah bint Jahsh established in that matter; because she is in the ruling of a woman with irregular bleeding according to the scholars.
As for if the miscarriage of the fetus occurs in the fifth month or after, it is washed, shrouded, and prayed over, and it is named, and a sacrifice is made for it; because by that, it has become a human being with the ruling of children.
And Allah the Exalted is the one who grants success.
