Q2: His wife miscarried in her early months, and a piece of flesh the size of a fist came out of her. What are the rulings that apply to her? Please advise us, may Allah reward you.
A2: If a pregnant woman miscarries a piece of flesh, a clot, or a lump in which the form of a human being is not discernible, then the ruling of a child does not apply to it, in terms of praying over it, nor does the waiting period end because of it, nor does the ruling of post-natal bleeding apply to it. Accordingly, she should not pay attention to any blood she sees, unless the blood coincides with the days of her usual period, in which case it is considered menstruation. However, if the form of a human being is discernible in it, which is usually the case when it reaches three months, and the minimum period in which this is discernible is eighty-one days, then the ruling of a child applies to it in terms of the waiting period ending because of it and the ruling of post-natal bleeding applying to it. Any blood she sees during the period of post-natal bleeding is post-natal blood; she leaves off prayer and fasting for it and makes up the fasting she missed during her days of post-natal bleeding. But this miscarried fetus is not washed, shrouded, or prayed over until it reaches four months. Imam Ahmad was asked: When is it obligatory to pray over a child? He said: When it has reached four months, because the soul is breathed into it when it reaches this duration. If it is less than this
duration, it is not washed, shrouded, or prayed over, but it is wrapped in a cloth and buried in a hole because there is no life in it, so it is not a soul before four months. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
