The Shaykh : Now, the author (may Allah have mercy on him) did not mention what happens if one has intercourse after the exit from the state of consecration, but others did. They said that if one has intercourse after the first exit from the state of consecration, it is obligatory for him to go out to the non-sacred area and enter the state of consecration again. That is, he must take off his non-sacred clothes and put on an izar and a rida' so that he can perform the Tawaf of Ifadah while in the state of consecration. Why did they say this? Because his state of consecration became invalid, meaning the remainder of his state of consecration became invalid, so he had to renew it. Does he owe a fidyah? The answer is: he owes a fidyah, and the explanation of the fidyah will come later, if Allah wills. So, if one has intercourse after the first exit from the state of consecration, several things follow: sin, the invalidity of the state of consecration, the obligation to go out to the non-sacred area to enter the state of consecration from there, and the fidyah. This is if he had intercourse when? After the first exit from the state of consecration. For example, a man who threw the pebbles and shaved his head on the day of 'Id, then slept with his wife and had intercourse with her before performing the Tawaf and Sa'y. So he commits a sin, he owes a fidyah, his state of consecration is invalid, and he must go out to the non-sacred area to enter the state of consecration from there.
